New Criminal Law Comes into Effect Nationwide Starting Today

Today is July 1. The new criminal law is coming into force in the country from today. This new law brought by the central government will now be implemented from our local police station to the Supreme Court. We are throwing away another 164-year-old canopy of slavery. Bharatiya Nyaya Samhita (BNS) will replace IPC, Bharatiya Civil Safety Code (BNSS) will replace CrPC and Bharatiya Sakshya Adhiniyam (BSA) will replace Indian Evidence Act. From now on, the age limit for children will be up to 18 years..has been raised from 16 to 18. Sexual intercourse is allowed only after 18. Until then, the law strictly prohibits sexual intercourse.

The new law empowers courts to impose sentences without parole. Henceforth, registration of complaints and further action will be as per the new law. All previous offenses will be dealt with as per current law. All the proceedings in the cases registered now shall be completed as per existing law. The Bharatiya Nyaya Sanhita, which replaces the IPC, places great emphasis on preventing crimes against women and children. While there were 511 sections in the old IPC, it has been reduced to 358 sections in the BNS.

A new Department of Social Services was also included. Those who are accused in minor cases cannot be exonerated without performing community service. Digital evidence will be accepted in the new law if there was no room for digital evidence in the Indian Evidence Act earlier. All digital interactions including video, WhatsApp, photo, voice message, mobile and computers will be recorded as evidence.

The IPC criminalises acts such as rape, molestation, stalking and insulting the dignity of a woman. BNS maintains these conditions. In case of gang-rape, the threshold for classifying the victim as major is increased from 16 to 18.
