Commenting on a Woman’s Body Structure Also Constitutes Sexual Harassment; High Court

The High Court has ruled that commenting on a woman’s body structure constitutes an insult to her dignity. Justice A. Badharudeen stated that unnecessary descriptions of a woman’s body or sending obscene messages cannot be seen as devoid of sexual intent.

The observation came while hearing a plea from a former KSEB employee seeking to quash a case filed against him under charges including sexual harassment. The complaint was filed by a female colleague alleging that he commented on her physical beauty and sent her sexually suggestive messages over the phone.

The case was registered in 2017, and the accused approached the High Court to have it dismissed. The petitioner argued that the comment about a “fine body structure” was not sexually suggestive. However, the court dismissed his plea, noting that similar behavior had been reported against him in the past.
