The Kerala High Court has made a landmark decision, stating that assaulting a person in custody is not part of the police’s duty. The court further clarified that such actions will not be protected under the law.
The ruling came in response to a petition filed by the Sub-Inspector (SI) of Nilambur, C. Alavi, who sought to have a custodial torture case dismissed. The Single Bench of the High Court upheld the Magistrate’s Court order, rejecting the petition.
