Kerala HC Quashes Black Flag Protest Case Against CM Pinarayi Vijayan

Kochi: The Kerala High Court has quashed a case against Congress workers who waved black flags in protest against Chief Minister Pinarayi Vijayan. The incident occurred on April 9, 2017, in Paravur. A single bench of the High Court delivered the verdict.

The court observed that black flag protests are neither defamatory nor insulting and that using flags of any color during a protest is not unlawful. The charges of obstructing police officers’ duties were also dismissed.

The bench noted that minor force during protests is natural and emphasized the need to avoid legal action over trivial issues. The court further criticized unnecessary litigation, stating, “If cases are filed for everything, there will only be time to file cases.”
