Union Home Minister Amit Shah has ordered the State Home Secretary to conduct an inquiry into the complaint of Retired Supreme Court Justice Cyriak Joseph about the acquisition of wealth beyond his income. The action is based on a complaint filed by human rights activist Jomon Puthanpurakkal to the Union Home Minister. In a letter sent by the Secretary of the Central Home Department to the Principal Secretary of the State Home Department, an inquiry has been directed.
The state home department had written to the state law secretary asking the legal side of the investigation against retired Judge Cyriak Joseph. The Secretary of the Law Department had also given legal advice to the State Home Department that further action could be taken regarding the investigation against Justice Cyriak Joseph.
The State Home Secretary had written to the Registrar General of the Kerala High Court to investigate and report on the complaint of disproportionate assets by Cyriak Joseph. The High Court Registrar General replied to the Secretary of the State Home Department by pointing out that the High Court has no mechanism to investigate some of the matters against Cyriak Joseph and that most of the matters mentioned in the complaint should be investigated by the Home Department. Rarely in history has a Supreme Court ordered a probe against a retired judge in a complaint of disproportionate assets.
