Dramatic developments in Delhi. Delhi Chief Minister Arvind Kejriwal’s earlier anticipatory bail has been blocked by the High Court. The high court’s dramatic move comes when he starts coming out of jail. A decision of this kind has come minutes before Delhi Chief Minister Arvind Kejriwal was released from Tihar Jail, a rare move in the history of justice. The High Court immediately quashes the execution of an accused in jail who has been granted bail within hours of being granted bail.
The Delhi High Court has now taken such a stand on a plea filed by the Enforcement Directorate a few minutes before his departure from Tihar Jail. Perhaps the reason for such a stand was that the High Court or the High Court felt that there had been some lapses in the sanctioned procedure. or such a move, stay order, will not prevent the execution of bail granted.
The trial court and the prison authorities have been given an urgent instruction that the bail granted to Kejriwal should not be processed until the petition is considered when he made a move to be released.
Additional Solicitor General of India SV Raju appeared for the ED. He challenged the trial court’s decision to grant bail as perverse. The court has said that the order of the court is completely wrong and there is no direct evidence. This is a false statement by the Court and the Court’s remark that there is no direct evidence is baseless.
