Consensual Extramarital Sex Cannot Be Considered Rape; Supreme Court

The Supreme Court has ruled that consensual extramarital sexual relations cannot be considered rape, observing that it is unfortunate when women file rape complaints after relationships break down, especially when the sexual encounters were based on mutual consent. Justices B.V. Nagarathna and N.K. Singh made the ruling.

The court quashed a rape case filed by woman S. Jadhav against Mahesh Damu Khare at the Kharghar police station in Mumbai, stating that complaints regarding broken promises of marriage should not be made after the relationship has ended.
