The Supreme Court has issued crucial directions in petitions related to amendments in the Waqf law. The court’s main recommendation is that properties declared as Waqf should not be denotified. Waqf properties, whether through usage or court order, should not be reclassified as anything else. The court also directed that, except for ex-officio members, all members of the Waqf Council must be Muslim.
The Supreme Court clarified that while collectors can investigate Waqf land, the properties cannot be reclassified during the investigation process. The court further mentioned that although the case has moved to an interim order today, further arguments will be heard tomorrow, and a final interim order may be issued after that. The court expressed concerns that converting Waqf properties into non-Waqf properties through usage could lead to significant repercussions.
The case will be reconsidered tomorrow at 2 PM, and the court clarified that only three lawyers from the petitioners will be allowed to present their arguments. The court also raised concerns about the recent conflict in Murshidabad related to Waqf law amendments.
